Managing Partner of Juris Ferrum Law Firm Comments on New Law No. 4778-IX on Pershyi Miskyi

The new Law No. 4778-IX has already been dubbed the “Shelter Law.” In reality, however, its scope is considerably broader. The Law introduces changes to the rules governing urban planning, civil protection, and the design of new construction projects, meaning that its provisions will have practical implications for developers, architects, local self-government authorities, and property owners.

These changes were discussed on the “Interview of the Day” programme on “Pershyi Miskyi” TV channel by Ganna Gnizdovska, Managing Partner of Juris Ferrum Law Firm, attorney and Secretary of the Construction Law Committee of the Odesa Regional Bar Council.

📌 The programme focused on the key changes introduced by Law No. 4778-IX:

🔹 Are shelters now required to be included in building designs?
For certain categories of new construction projects, the design documentation must provide for a civil protection protective structure or a dual-purpose structure.

🔹 What is the difference?
A civil protection protective structure is a structure specifically constructed to protect the population. A dual-purpose structure is a facility used for its primary purpose under normal conditions but capable of serving as a shelter in the event of an emergency.

🔹 What happens if the new requirements are not met?
Where the law requires a protective structure to be provided for, its absence from the design documentation may constitute grounds for refusing to issue the relevant construction permits or authorisations and may also give rise to liability under urban planning legislation.

🔹 Do the new rules apply to construction projects that have already commenced?
No. The Law does not have retroactive effect. The new requirements apply only to projects for which the right to perform construction works is obtained after the Law enters into force.

Despite its commonly used name, Law No. 4778-IX is not merely about shelters. It introduces comprehensive changes in the fields of civil protection and construction that will soon affect the design, approval, and implementation of new construction projects.
