We determined that the seizure had been imposed more than ten years ago as part of enforcement proceedings.
The writ of execution was issued by one of the district courts of Odesa. The court granted the bank's claim in a credit case regarding debt collection.
The enforcement case materials had long been destroyed, and the period for presenting the enforcement document for execution had expired.
WHAT WAS DONE:
Our attorneys:
- gathered information about the seizure of the client's property;
- submitted a petition to the State Enforcement Service requesting the removal of the seizure (as expected, the request was denied);
- prepared and filed a complaint in court against the inaction of the state enforcement officer.
RESULT:
The court upheld the complaint against the inaction of the state enforcement officer and ordered the authorized representative of the State Enforcement Service to lift the seizure.
