📅 On January 23, Ganna Gnizdovska, attorney-at-law, Ph.D. in Law, Managing Partner of Juris Ferrum Law Firm, and Deputy Chair of the Appeals Commission of the National Anti-Doping Center, delivered a lecture as part of the "Lawyers' Club."
The event was traditionally organized by the Academy of Consulting Business for lawyers from various fields of law.
🏟️ Why is this important?
Doping allegations can significantly impact an athlete’s career. It is crucial to respond appropriately and build an effective defense strategy to not only prove innocence but also protect the client’s reputation.
💡 Key points of the lecture:
1️⃣ What is doping, and what are the types of violations?
Doping refers to committing one or more violations of anti-doping rules, ranging from the presence of prohibited substances to sample manipulation. Violations include refusing doping control, using prohibited substances, manipulating samples, or even employing banned treatment methods.
2️⃣ How to act when accused?
Immediate response is essential: from collecting evidence to preparing explanations. It is crucial to thoroughly review all stages of doping control and gather necessary documents.
3️⃣ Therapeutic Use Exemptions (TUEs)
If an athlete uses a prohibited substance for medical reasons, it is vital to obtain a TUE to demonstrate the necessity of using the substance for treatment.
4️⃣ Timely submission of athlete whereabouts
Updating information in the ADAMS system, which tracks athlete locations for out-of-competition testing, is essential. Failure to update this information on time may lead to severe sanctions.
5️⃣ CAS – Key Cases
Reviewing notable cases, such as Sun Yang, highlights the importance of considering all aspects of evidence and procedural details. Precedent-setting decisions help shape effective defense strategies.
🌟 We sincerely thank the Academy of Consulting Business for organizing such an important lecture and all participants for their insightful questions and active discussions!
