As part of the forum, a panel discussion titled “Sports Law: Current Issues of Legal Practice” took place, bringing together leading experts, representatives of sports federations, academics, and legal practitioners.
The event was organized by the Yaroslav Mudryi National Law University, the Ministry of Education and Science of Ukraine, the National Olympic Committee of Ukraine, and the National University of Physical Education and Sport of Ukraine.
Ganna Gnizdovska, Managing Partner of Juris Ferrum Law Firm, participated in the panel discussion with a presentation on: “Legal Issues in the Adjudication of Anti-Doping Rule Violations.”
Key Points of the Presentation:
- disputes often arise between national anti-doping organizations over who has the authority to handle a particular case;
- in cases of jurisdictional disputes in doping-related cases, they are resolved by the World Anti-Doping Agency (WADA);
- decisions made by national anti-doping organizations can only be appealed to the Court of Arbitration for Sport (CAS).
- the lack of clarity in the relationship between the jurisdiction of national bodies and CAS creates legal conflicts that require harmonization.
